Okay, so last but not least:
Q: Should judges be IP specialists?
A: Reasonable minds can differ on this one. But it's my view that our current approach (generalist judges, at least at the trial court level) is the right approach. In the jurisdictions I'm familiar with that have specialist IP judges, there is still a troubling patent-centricism in the selection of judges. And in our limited experiment with specialized patent judges, the Federal Circuit, is considered by many to be a failure.
