Fair! Although you're never really "forced" to do an on-chain transaction; you can create schemes where your recovery path is still pretty safe, so you're not in a rush when the timeout expires.

For example, the recovery path could be a multisig 2of2 between a recovery buddy and a hot key (you backup the xpriv of the hot key together with the descriptor).

If using taproot, the recovery buddy can't even see your UTXOs if you don't tell them the descriptor!

So if fees are high when the timeout expires, maybe you're not scared of waiting some time.

(Of course, I wouldn't recommend such setup to beginners at this time)
