The New Deal was not unlike the administrative State today, like the ATF or the IRS, the ND agencies made rules that they could enforce like laws without needing legislation to pass a particular law.
They could change the way they interpreted a law and the rules based on that law.
Like today you could spend the next half a decade in court and a ton of money to defeat them, maybe, so the herculean effort may not even pay off.
