It *is* a valid argument to say: "this kind of a thing can be used as a tool of oppression, and in fact it has in the past; this is a dangerous thing to put into law."

Yes, EU is a bit more democratic than Kazakhstan, but Hungary and Poland are in the EU and what good did that do for the lawfulness of state actions? Not all that much.
