That's not a terrible point. Although any market has pricing mechanic issues. That's definitely overly reductive in concluding it's not trustless, though. The most you can lose is fees, same as with Lightning. If you also overly reduce Lightning to say it's not trustless, then I would say you're being intellectually honest with that point.

Nothing is truly trustless in reality. Even Bitcoin can experience reorgs.

I'd accept an intellectually honest agreement that trust minimized swaps exist.
