Over Christmas Sandie had received a call from the hospital telling her that there had been a “serious complaint” about her.
A few days later she was told she had been formally suspended and could not go back to work until an internal investigation had been completed (she was cleared by that investigation just this week).

By the time we spoke in January 2024, Sandie had been off work and had no correspondence from the hospital for nearly three weeks.
She hadn’t been following the gender debate. She didn’t know about my case.
She just knew it was wrong to deprive her of privacy and dignity when changing at work.

On Christmas Eve Sandie had started her period unexpectedly, and went into the changing room embarrassed that she might have bled on her trousers.
She encountered Beth again. This time Sandie spoke up.

When she told me over the phone about this confrontation, I didn’t know how small Sandie is, or about her history of being sexually assaulted by a doctor as a young woman (which came out in the tribunal). But I could hear her voice shake. She was angry, shocked and frightened. Her trade union wasn’t helping and she didn’t know where to turn.

I first heard about Sandie’s case in January 2024, when @npub12ek…6gyw sent Sex Matters a message:
“Hi folks, I have a constituent who has been a staff nurse in our local A&E for over 20 years. She has been suspended for requesting privacy in the changing room. She’s premenopausal and found herself in a bit of a bind. A doctor who is a trans-identifying man refused to give her privacy and claimed her request was bullying. Many colleagues share her concerns, but are too frightened to say anything. Looks like her employer is misinformed of the law and her union RCN appears to be offering very weak support.”

Sandie spoke to me two days later and told me her shocking story.
She had been half-undressed in the changing room when the young trans-identifying male doctor known as Beth walked in.
The next day she asked her line manager for help. Her line manager said she understood and would sort things out. But the second time it happened, the line manager said she had called equality and diversity and was told Beth could continue getting changed in the female changing room.

Some trans people argue that they need to use opposite-sex facilities or they will be "outed".
But using opposite-sex facilities infringes on the rights of the people they are intended for.
The EqA addresses the conflict of rights. Her rights v his rights and says "no".

Having the protected characteristic of "gender reassignment" does not change a person's sex (and does not require surgery etc...)
Other people can often tell, or have a right to know whether they will be sharing a space with people of the same sex or both sexes.

Article 8 is a qualified right.
It is important to read 8(2)... there are lots of situations where it is lawful to put limits on a person's privacy and their freedom to do what they want.
Those limitations should be in line with the law.

The Equality Act 2010 and the Health and Safety at Work Act 1974 are laws that limit people's freedom.
The Equality Act outlaws sex discrimination but allows single-sex services.
The HSWA includes responsibilities related to toilets at work.
This engages Art 8 and Art 8(2)

I was called to give evidence because the hospital board and doctor refused to accept as agreed facts that men and women are different when it comes to the propensity for violence and sexual crimes, and that this difference remains despite identity claims.

As I was to be a witness, I wasn’t allowed to watch Sandie’s evidence session. I waited with her mum and sister who told me something of what she has been through. I told them how many women and men stand behind Sandie.
