They are subject to a time lock and are unspendable until the (usually 2 week) window is expired.
The window is required for the opposing party to contest the unilateral close if the channel payout don't reflect the latest state (attempting to cheat).

This still has to get through congress, so it will get scrutinized from every direction. If political opponents see that it doesn't have provisions against money laundering & terrorism, the bill won't pass and no progress will be made.
Of course I don't love it, but I'm also a realist.

This is a pretty good point. Bitcoin is built to be accountable, which is at odds with privacy goals. Lightning is a good addition of complexity, but without guarantees.
I feel like Bitcoin is appropriately built for use by governments and institutions, which allows the people to sousveil activity. This is an extremely important feature as Bitcoin grows in adoption.
For more privacy-oriented money, scalability and trading liquidity are essential along with mathematical privacy guarantees.

Lightning is Bitcoin. Bitcoin is not scalable to all people.
Reaching all people isn't exclusively a lightning problem; it's a Bitcoin problem.
If a user is using a custodian, they're using a database, not lightning. Basically a claim, not lightning.
