2/ Under the #DSA, VLOPs must provide at least one recommender option not based on profiling.
While Youtube formally offers one, accessing is not easy. Users must navigate through multiple layers of settings, interpret technical terminology, & actively override default configurations.

2/ The Commission's findings highlight a long-standing concern: engagement-optimised design comes at the expense of users’ physical and mental well-being and can pose grave risks to democracy and public debate.

Today, #Australia enforced a social media ban for kids under 16.

5/6 ⚠️ Mass surveillance could present itself in two ways: 1) if the Council's preferred voluntary scanning regime is extended indefinitely, #BigTech companies could be allowed to scan the messages of users without any need for suspicion of CSAM crimes.
2) the Council also wants to make it mandatory for most or all private communications services (emails, Signal messages, WhatsApp, etc.) and app stores to use age verification or similar tools. This would have a huge chilling effect.

On Friday, the @npub1m96…ag4y hit X with a €120M fine for deceptive practices for violating the #DSA.
Even if the fine comes late, Musk's reaction on social media and the US government's irresponsible threats against the EU show that we're on the right path. X's decision to terminate the EU Commission's account on the platform also highlights how critics are processed by the platform & how risky our dependency on Big Tech has become.

⚠️ The Ombudsperson's findings on the Commission's maladministration also included those the #deregulation agenda: The Commission also did not follow proper rules for the Omnibus proposal on corporate sustainability and due diligence and on the Common Agricultural Policy.
This assessment shows serious procedural shortcuts from the EU's executive body that has clearly resulted in rushed and harmful lawmaking. The #DigitalOmnibus launched last week is a result of the same.

4/5 🚫 The Council's text also requires providers of many different online services to take steps to mitigate the risks posed by their platforms.
Sounds great in theory but providers could be forced to take measures which may create more harms such as allowing private messages (chats, emails etc.), app stores, and others deemed "risky" to use age verification or assessment tools. This can undermine hashtag#privacy and pose a major chilling effect on people's freedoms.

This means that Big Tech companies can decide to scan your personal messages, without suspicion that you're doing anything wrong, and apply error-prone predictive AI tools to look for evidence of abuse. This sort of scanning already happens, with very little transparency and and oversight, and no proper legal basis.

The Digital Fairness Act (DFA) can change that, by banning manipulative design & making fairness-by-design the norm.

The two tech giants made unnecessarily difficult to access data and, in Meta’s case, used deceptive interface design that confuses & discourages users from flagging illegal content.

In a nutshell: genuine simplification should make rules clearer, enforcement stronger & justice accessible.
Simplification means:
✅ Clearer rules and stronger enforcement
✅ Strengthen protections for people, not weaken them
✅ Ensure equal access to rights for all communities, especially those most affected by technology harms.
Anything less risks rolling back years of progress, putting 500 million people at risk of privacy, equality, and security breaches.

But that’s not it: the process itself is deeply flawed. Short consultation timelines, industry-dominated “reality checks,” and optimistic impact assessments leave little room for alternative views.
That’s not meaningful participation: it creates legal uncertainty and reduces scrutiny, undermining democratic oversight, while leaving room for corporate wish-lists.

The Omnibus also targets the EU’s new AI Act before it’s even in force.
While the Act could go further, it’s a major step for accountability, transparency and fairness in AI. Cutting or delaying it now would create legal uncertainty & make it harder to enforce rights.
Meanwhile, the Commission’s other plans – like “AI Continent”, “Apply AI” - push for massive AI adoption at the risk of trampling privacy, environmental protections & public accountability

Then we have cookie banners: Article 5(3) of the ePrivacy Directive, a cornerstone of EU digital rights.
Under the pretext of “cookies annoyance”, the Commission is ready to cut on rules that protect the privacy and confidentiality of our communications.
Weakening them means more silent surveillance by companies and governments.
The fix isn’t deregulation, it’s better enforcement and privacy-by-design tools that make choices simple.

The deadline for EU countries to enact the law and designate national authorities passed on 2 August. Almost none of the countries have done this 🙅🏽‍♀️
The Commission itself is also becoming a roadblock 🚧

🚨 Age verification is NOT a silver bullet for online safety.
Quick fixes like age gates don’t stop toxic design, addictive patterns, or harmful content. Plus it risks restricting children’s rights & excluding those without IDs or devices.

🚨 One year on, the enforcement and implementation of the landmark law has been riddled with challenges. Worryingly, EU lawmakers seem to be caving in to calls from tech companies to pause, delay and even gut crucial parts of the #AIAct - which will be disastrous for our right. 🔠 In Google’s Alphabet, C stands for control, not compliance.
That’s why with [@article19org](https://birdsite.miisu.net/users/article19org ), @npub1k06…vzge, @npub1ak9…l8u5, @npub1qap…8fc5 @npub1lgg…cfpn, we have filed a formal #DMA complaint vs. Alphabet.
Despite clear rules, Android users can’t uninstall pre-installed Google apps, only disable them.
This is deceptive design that limits real choice.
📣 We urge @EU_Commission to act & enforce the #digitalmarketsact.

📝 Yesterday, nine civil society organisations, including @npub1w4r…8cxz, submitted a joint complaint against X for violating the #DSA by using people’s sensitive personal data for targeted ads.
🚨 This is banned under the DSA because it can lead to higher risk of discrimination, harm and violations of users’ fundamental rights.
Together, we are calling for Digital Services Coordinators and the European Commission to investigate X, and hold it to accountable ✊🏽
