A competent judge would tell an attorney to stop lying if he claimed that copyright infringement is theft - but it seems that judges are the complete opposite to competent.
Copyright infringement is a violation of a government granted monopoly and the government does not regards "violations" of such monopoly as theft.
Being able to think clearly about something is a functional purpose.
